The SC has issued an order for Koshi Province to form a new govt. within seven days

Kathmandu : The Supreme Court has issued an order to form a government of the majority party in Koshi Province within 7 days. The full bench of the Supreme Court issued the order on Wednesday to initiate the process of forming a new government in Koshi Province.

The Chief Minister’s appointment was challenged as unconstitutional by the Speaker of the Provincial Assembly, leading the Supreme Court to direct the process of forming another government.

As per the order, another government will be formed in accordance with Article 168 (2) of Nepal’s Constitution.

According to the relevant clause, “In case no party has a clear majority in the Provincial Assembly to elect the Chief Minister, the Provincial Head shall appoint the Chief Minister from among the leaders of the two or more parties capable of forming a majority with the support of other parties in the Provincial Assembly.”

If within seven days, any party fails to gather a majority as mentioned in Section 168 (3), a government will be formed under the leadership of the largest party in the province.

The aforementioned constitutional provision states, “In the event the final results of the Provincial Assembly election are announced within thirty days, and the Chief Minister cannot be appointed as per Subsection (2) or if the Chief Minister appointed as per that provision fails to obtain a vote of confidence as per Subsection (4), the Provincial Head shall appoint the leader of the parliamentary party with the highest number of members in the Provincial Assembly as the Chief Minister.”
